Former NBA All-Star Rajon Rondo is seeking to have his unlawful carrying of a handgun charge dismissed.

Per court documents obtained by TMZ Sports, Rondo's attorneys filed a motion to dismiss the charge by arguing it is unconstitutional because he's protected by the Second Amendment.

"The statute under which Rondo is charged fails to be consistent with the Nation's historical tradition of firearm regulation," the documents state.

Rondo is also facing charges of possession of marijuana and one count of possession of paraphernalia in the case.

The two-time NBA champion was arrested in Indiana on Jan. 28. He was initially pulled over by police on a routine traffic stop, but officers conducted a search after smelling marijuana inside the vehicle.

Police found a firearm, drug paraphernalia and suspected marijuana. He was taken to Jackson County Jail, but was able to be immediately released after posting bond. His initial court hearing was on Tuesday.

Rondo was prohibited from carrying a gun stemming from a 2022 incident when he was alleged to have pulled a gun on Ashley Bachelor, his former partner and mother of his children. She filed an emergency protection order at the time, seeking protection for herself and two children.

The case was dismissed in June 2022 after Rondo and Bachelor reached an unspecified agreement.

TMZ noted the judge hasn't made a ruling on Rondo's motion to dismiss the charge. There is a hearing scheduled for late-March.

Rondo hasn't officially retired from the NBA, but he hasn't played in the league since the 2021-22 season. He won championships in 2007-08 with the Boston Celtics and 2019-20 with the Los Angeles Lakers.
